A temporary contract of employment cannot be concluded for hazardous works unless the responsible of the user undertaking requests an authorization to the labour Inspectorate.

According to the French labor code (Article D. 4154-1) the works which expose to the following hazardous chemical agents are forbidden by temporary workers and employees on fixed-term contracts :
- asbestos,
- aromatic amines,
- sodium arsenite ,
- hydrogen arsenide,
- manufacture of auramine and magenta,
- beryllium and its salts,
- beta-naphtylamine,
- Bromine liquid or gaseous forms ,
- cadmium : metallurgical works and smelting,
- solubles and mineral compounds of cadmium,
- gaseous chlorine with the exclusion of compounds,
- methyl chloride,
- vinyl chloride during the polymerization,
- mercury dichloride, oxycyanide mercuric and alkyl derivatives of mercury,
- manganese dioxide,
- fluorine gas and hydrofluoric acid,
- Iodine solid or gas ou vapeur, with the exclusion of compounds,
- carbon oxychloride,
- paraquat,
- phosphorus, phosphorus pentafluoride, hydrogen phosphide,
- flax dusts : exposure through inhalation,
- dusts of hard metal,
- ionising radiations : in areas where the dose rate may exceed 2 millisieverts,
- carbon disulphide,
- tetrachloroethane,
- tetrachloromethane,
- disinfestation of woods
According to the French labor code (Article D. 4154-2), these prohibitions do not apply when works are done inside of an apparatus hermetically sealed .
Requested derogation by the employer
A derogation shoud be request to the labor inspector so that the temporary worker or the employee on fixed-term contract is allowed to do works prohibited by the French labor code. The occupational physician and the company’s health, safety and working conditions committee have to give their opinion.
