The employer has to fill in a sheet on the prevention of exposures (a french document called \u00ab Fiche de pr\u00e9vention des expositions \u00bb) \u00a0for the employees having an arduous work or for those being exposed to certain hazards. A decree states the\u00a0hardship factors. \u00a0The exposure to such occupational hazards, for a certain period, \u00a0will allow certain workers to retire earlier.<!--more--><\/p><\/blockquote>\n<p><a href=\"#lien1\">Hardship at work in the French Labour code<\/a><br \/>\n<a href=\"#lien2\">Decree 2011-354 has defined the\u00a0harshness factors<\/a><\/p>\n<p>&nbsp;<\/p>\n<h3><a name=\"lien1\"><\/a>Hardship at work in the French Labour code<\/h3>\n<p>The French Labour Code states in the <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000023032092&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120101\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article L4121-3<\/a> (2010) that the employer must list the [x] for each employee exposed to at least one [professional risk factor] determined by decree and related to (i) strong physical constraints, (ii) an aggressive physical environment or (iii) a specific working schedule likely to harm the employee\u2019s health in a noticeable and irreversible manner over the long-term.<\/p>\n<p><strong>For a worker exposed to one or several hardship factors <\/strong>defined by the decree, the employer has to fill in a <em>prevention of exposures sheet<\/em> (it is a specific french document called &#8221;\u00a0<strong>Fiche de pr\u00e9vention des expositions<\/strong>&#8220;), where he lists the hardship factors and details for each of them : since when the exposure started and what are the preventive measures taken.<br \/>\nThis document must be\u00a0established in compliance with <a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/single-document-evaluation-occupational-risks\/\" target=\"_blank\" rel=\"noopener\">the single document for the evaluation of occupational risks<\/a>\u00a0and <strong>sent to the occupational physician<\/strong>\u00a0who must keep it safely in the medical record of occupational health.<br \/>\nThe employee may require the employer to bring a<strong> correction of the information<\/strong> if he does not agree with it.<br \/>\nA<strong> copy of the document<\/strong> is given to the employee\u00a0when he leaves the company, or when he is\u00a0on sick leave or when he makes a declaration for an<a href=\"http:\/\/www.atousante.com\/en\/occupational-diseases\/\" target=\"_blank\" rel=\"noopener\"> occupational disease.<\/a><br \/>\nThe <strong>information<\/strong> of this document is<strong> confidential<\/strong>, it must not be given to somebody else than the employer or the occupational physician.<br \/>\n<strong>In the event of the death of the employer<\/strong>, a copy of the document may be sent to his descendent\/family.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Hardship conditions at the work station are characterized by :<\/strong><\/p>\n<ul>\n<li>the exposure to one or more occupational risks likely to harm the employee\u2019s health in a noticeable and irreversible manner over the long-term<\/li>\n<li>the factors defined by decree, related to strong physical constraints, an aggressive physical environment or to specific working schedule<\/li>\n<\/ul>\n<p><span class=\"bloc-important\">According to the French Social Security, psycho-social risks are not considered as hardship factors because they do not meet the definition &#8221;\u00a0likely to harm the employee\u2019s health in a noticeable and irreversible manner over the long-term&#8221;.<br \/>\n<\/span><\/p>\n<h3><a name=\"lien2\"><\/a>Decree 2011-354 defines the harshness factors<\/h3>\n<p>According to the French\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do;jsessionid=C992BD77CBC6B2668FF92E86F3254677.tpdjo14v_1?cidTexte=LEGITEXT000006072050&amp;idSectionTA=LEGISCTA000023794022&amp;dateTexte=20110710&amp;categorieLien=id#LEGISCTA000023794022\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Decree 2011-354\u00a0<\/a>and the French Labour Code\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000023794645&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20140506&amp;oldAction=rechCodeArticle&amp;fastReqId=974301278&amp;nbResultRech=1\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article D. 4121-5<\/a>, the following factors are considered as hardship conditions :<\/p>\n<p><strong>1\u00b0 \u00a0Strong physical constraints\u00a0<\/strong><br \/>\na) Manual handling of loads, according to the French Labour Code\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000018528909&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120725&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article R. 4541-2<\/a>\u00a0;<br \/>\nb) Painful physical positions are defined as\u00a0forced joint positions\u00a0;<br \/>\nc) Mechanical vibrations,\u00a0according to the French Labour Code\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000018530289&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120725&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article R. 4441-1<\/a>\u00a0;<\/p>\n<p><strong>2\u00b0 Aggressive physical environment \u00a0<\/strong><br \/>\na) Hazardous chemical agents according to the French Labour Code\u00a0\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000025739703&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120814&amp;fastPos=1&amp;fastReqId=1031440802&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">R. 4412-3<\/a> et <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000025739694&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120814&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">R. 4412-60<\/a>, including fumes and dusts ;<br \/>\nb) Work with hyperbaric conditions,\u00a0according to the French Labour Code\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000023414500&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120725&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article R. 4461-1<\/a>\u00a0;<br \/>\nc)\u00a0Extreme temperatures ;<br \/>\nd) Noise exposure according to the French Labour Code\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000018530390&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120725&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article R4431-1<\/a>\u00a0;<\/p>\n<p><strong>3\u00b0 Specific working schedule\u00a0<\/strong><br \/>\na) Night work according to the French Labour Code\u00a0<a
