That is why he has to write a prevention of exposures sheet ( a french document called &#8220;Fiche de pr\u00e9vention des expositions&#8221;) \u00a0for the employees who have an arduous work, are exposed to certains hazards. \u00a0Then the employer must negotiate an agreement or develop an action plan \u00a0that will allow employees who have an arduous work to work longer\u00a0and to maintain their own health.<!--more--><\/p><\/blockquote>\n<p><a href=\"#lien1\">Prevention of exposures sheet ( a specific French document called &#8220;Fiche de pr\u00e9vention des expositions)<\/a><br \/>\n<a href=\"#lien2\">Action plan to prevent hardship at work\u00a0<\/a><br \/>\n<a href=\"#lien4\">Obligatory topics in the action plan to prevent hardship at work<\/a><br \/>\n<a href=\"#lien5\">Plan to prevent hardship at work :\u00a0control of the French administration<\/a><\/p>\n<h3><a name=\"lien1\"><\/a> Prevention of exposures sheet (a specific French document called &#8220;Fiche de pr\u00e9vention des expositions)<\/h3>\n<p>A prevention of exposures sheet ( a specific french document called &#8220;Fiche de pr\u00e9vention des expositions) must be done when the worker is\u00a0working in arduous or hazardous occupations. Prevention&#8221; is not a very good term because in fact this \u00a0document, called in French &#8220;Fiche de pr\u00e9vention des expositions&#8221; keeps track of professional exposures\u00a0to\u00a0harshness factors\u00a0but do not prevent the professional exposures<\/p>\n<p><a href=\"http:\/\/www.legifrance.gouv.fr\/jopdf\/common\/jo_pdf.jsp?numJO=0&amp;dateJO=20120131&amp;numTexte=41&amp;pageDebut=01796&amp;pageFin=01797%20\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">A sample sheet is given by the French labor code<\/a>.<br \/>\nAtouSante proposes a Word template in French for this document \u00a0\u00a0<a href=\"http:\/\/www.atousante.com\/en\/wp-content\/uploads\/2012\/02\/Fiche-de-pr\u00e9vention-des-expositions-\u00e0-certains-facteurs-de-risques-professionnels.doc\">Fiche de pr\u00e9vention des expositions \u00e0 certains facteurs de risques professionnels<\/a><\/p>\n<p>This document must be regularly updated.<\/p>\n<p>What are the differences between the<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/single-document-evaluation-occupational-risks\/\" target=\"_blank\" rel=\"noopener\"> single document for the evaluation of occupational risks<\/a> and this sheet of prevention of exposures ( a specific french document called &#8220;Fiche de pr\u00e9vention des expositions) ?<\/p>\n<p>The<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/single-document-evaluation-occupational-risks\/\" target=\"_blank\" rel=\"noopener\">\u00a0single document for the evaluation of occupational risks<\/a>\u00a0which is compulsory in any company since 2001 is\u00a0\u00a0essentially a tool for service\u00a0\u00a0while this sheet of prevention of exposures\u00a0\u00a0concerns the worker, keeps track of all the exposures to\u00a0harshness factors.<\/p>\n<p>This sheet ( a specific French document called &#8220;Fiche de pr\u00e9vention des expositions) must be transmitted :<\/p>\n<ul>\n<li>to the <strong><a href=\"http:\/\/www.atousante.com\/en\/health-work\/occupational-doctor\/\" target=\"_blank\" rel=\"noopener\">occupational physician<\/a> <\/strong>who keeps it safely in the medical record of occupational health,<\/li>\n<li>to the employee when <strong>he leaves the company<\/strong>,<\/li>\n<li>but also to the<strong> employee on sick leave<\/strong>\u00a0( when he has stopped to work for at least 30 days for occupational work or occupational disease, or 3 months for another disease).<\/li>\n<\/ul>\n<p>The employer can be assisted to establish this sheet (a specific French document called &#8220;Fiche de pr\u00e9vention des expositions)\u00a0:<\/p>\n<ul>\n<li>with the<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/single-document-evaluation-occupational-risks\/\" target=\"_blank\" rel=\"noopener\">\u00a0single document for the evaluation of occupational risks<\/a>, he has still done and which identifies the occupational hazards<\/li>\n<li>with \u00a0the &#8220;<a href=\"http:\/\/www.atousante.com\/en\/health-work\/occupational-doctor\/french-occupational-physician-responsibilities\/#lien6\" target=\"_blank\" rel=\"noopener\"> fiche d\u2019entrerprise &#8221; ( french document written by the occupational doctor <\/a>which identifies the occupational risks in the company),<\/li>\n<li>The<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/health-safety-working-conditions-committee\/\" target=\"_blank\" rel=\"noopener\"> health, safety and working conditions committee<\/a> can also help him because the French Labour Code states (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000023032089&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20140506&amp;oldAction=rechCodeArticle&amp;fastReqId=235108890&amp;nbResultRech=1\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\"> article L 4612-2<\/a>) that \u00a0the health, safety and working conditions committee\u00a0shall carry out the \u00a0harshness factors\u00a0analysis<\/li>\n<li>The <a href=\"http:\/\/www.atousante.com\/en\/health-work\/occupational-doctor\/french-occupational-physician-responsibilities\/\" target=\"_blank\" rel=\"noopener\">occupational physician <\/a>can also help the employer to establish these sheets because he\u00a0is an advisor to the firm\u2019s manager.<\/li>\n<\/ul>\n<h3><a name=\"lien2\"><\/a> Action plan to prevent hardship at work<\/h3>\n<p>The French Social Security Code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000023032112&amp;cidTexte=LEGITEXT000006073189&amp;dateTexte=20120101\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">&#8216;article L138-29 )<\/a>\u00a0explains when an action plan to prevent hardship at work must be established.<\/p>\n<p><span class=\"bloc-important\">Only the companies which are employing more than \u00a050 workers \u00a0have to negotiate about arduousness at work if at least 50 per cent of their employees are exposed to occupational risks which evokes tough working conditions at work<\/span><\/p>\n<h3><a name=\"lien4\"><\/a>\u00a0Obligatory topics in the action plan to prevent hardship at work<\/h3>\n<p><span class=\"bloc-important\">According to The French Social Security Code, \u00a06 topics are planned<\/span><br \/>\n<strong>At least 1 of this 2 issues must be discussed in the action plan to prevent hardship at work\u00a0\u00a0:<\/strong><\/p>\n<ul>\n<li>reducing \u00a0the professional exposure to harshness factors, by implementing actions to eliminate\u00a0or at least reduce \u00a0these harshness factors,<\/li>\n<li>work stations layout.<\/li>\n<\/ul>\n<p><strong><strong>At least 2 of this 4 issues must be discussed\u00a0in the action plan to prevent hardship at work\u00a0<\/strong>\u00a0;<\/strong><\/p>\n<ul>\n<li>Improvement of working conditions ( labour organisation, etc),<\/li>\n<li>skills development,<\/li>\n<li>adopting positive measures relating to the end of working life,<\/li>\n<li>keeping people at work, \u00a0preventing the professional exclusion of employees.<\/li>\n<\/ul>\n<h3><a name=\"lien5\"><\/a> Plan to prevent hardship at work : control of the French administration<\/h3>\n<p>When an agreement is \u00a0negotiated\u00a0or an action plan\u00a0developed, the employer has to forward it to the\u00a0Regional and &#8220;Departmental&#8221; Labour, Employment and Vocational Training Directorates, called in French, DRTEFP \u2013 <strong>D<\/strong>irection <strong>R<\/strong>\u00e9gionale du<strong> T<\/strong>ravail, de l<strong>\u2019E<\/strong>mploi et de la <strong>F<\/strong>ormation <strong>P<\/strong>rofessionnelle.<\/p>\n<p>It is the employer who decides which is the proportion of workers having an arduous work and he notes it in the<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/single-document-evaluation-occupational-risks\/\" target=\"_blank\" rel=\"noopener\"> single document for the evaluation of occupational risks<\/a>.<\/p>\n<p><strong>If the plan to prevent hardship at work is not made or\u00a0is considered to be insufficient<\/strong> by the labour Inspector, he notifies it to the employer. The manager has then \u00a06 months to make corrections. If it is not done,\u00a0the\u00a0Regional and &#8220;Departmental&#8221; Labour, Employment and Vocational Training Directorates, (called in French, DRTEFP
