{"id":6772,"date":"2014-06-01T22:00:29","date_gmt":"2014-06-01T20:00:29","guid":{"rendered":"http:\/\/www.atousante.org\/?p=6772"},"modified":"2018-02-19T09:16:28","modified_gmt":"2018-02-19T07:16:28","slug":"occupational-disease-compensation","status":"publish","type":"post","link":"https:\/\/www.atousante.com\/en\/occupational-disease-compensation\/","title":{"rendered":"Occupational disease : compensation"},"content":{"rendered":"<blockquote><p>An occupational disease is the consequence of exposure of varying duration to a risk that exists during the normal course of an individual\u2019s job.\u00a0A disease can be recognised as an occupational disease if it is on the lists appended to the Social Security Code.\u00a0\u00a0If the disease is recognised as occupational , the victim will receive compensation covering all costs.<!--more--><\/p><\/blockquote>\n<p>When the disease is recognised :<\/p>\n<ul>\n<li><strong>all the costs of care are covered by the Social security<\/strong><\/li>\n<li>and the victim will receive<strong>\u00a0daily allowance<\/strong>s which are paid by the Social security ( normal wage)<\/li>\n<li>until the healing \u00a0or the consolidation of the occupational disease.<\/li>\n<\/ul>\n<p>The daily allowances are paid by the Social security from the first day of the work stoppage and for all the duration of the work stoppage but the victim must observe the strictest possible the medical prescriptions and must submit to the controls of Social security : usually the victim must be at home between 9 and 11 AM and 14 and 16 PM.<\/p>\n<p>It is the same with the occupational accidents and with the occupational diseases, the physician must then establish a descriptive final certificate and must say if the victim is cured or only consolidated, i.e. the victim has after-effects after the occupational disease.<\/p>\n<p>In case of <strong>after-effects,<\/strong> the victim will receive a<a href=\"http:\/\/www.atousante.com\/en\/occupational-accidents\/recognition-compensation-occupational-accidents\/partial-permanent-disability-pension\/\" target=\"_blank\" rel=\"noopener\"> partial permanent disability<\/a> but only when the occupational disease or the occupational accident is consolidated. The physician of Social security \u00a0set the rate for the partial permanent disability, he uses a <a style=\"line-height: 1.5em;\" href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do;jsessionid=7207DA862F314C61A097245EE17E8E30.tpdjo13v_3?idSectionTA=LEGISCTA000019325196&amp;cidTexte=LEGITEXT000006073189&amp;dateTexte=20101025\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">scale for disability following an occupational disease<\/a>.<span class=\"bloc-important\"><span style=\"color: #333333; line-height:
