Physicians of all specialities must know this procedure but it is always the victim who decides to declare or not the illness as an occupational disease.<!--more--><\/p><\/blockquote>\n<p><a href=\"#lien1\">Presumption of occupational origin\u00a0<\/a><br \/>\n<a href=\"#lien2\">The declaration of the occupational disease<\/a><br \/>\n<a href=\"#lien3\">Original medical certificate<\/a><br \/>\n<a href=\"#lien4\">Inquiry<\/a><br \/>\n<a href=\"#lien5\">Final medical certificate<\/a><br \/>\n<a href=\"#lien6\"><br \/>\n<\/a><\/p>\n<h3><a name=\"lien1\"><\/a> Presumption of occupational origin<\/h3>\n<p>A disease can be recognised as an occupational disease if it is on the lists appended to the Social Security Code.\u00a0There are currently 112 such <a href=\"http:\/\/www.atousante.com\/en\/occupational-diseases\/list-tables-occupational-diseases\/list-french-tables-occupational-diseases\/\" target=\"_blank\" rel=\"noopener\">tables of occupational diseases.<\/a><\/p>\n<p class=\"bloc-important\">Any disease which meets the medical, occupational and administrative criteria given in the tables \u00a0is systematically presumed to be occupational in origin, without it having to be proven<\/p>\n<p>\u00a03 conditions must be met so that the illness \u00a0is recognised as occupational disease and the victim shall be compensated :<\/p>\n<ul>\n<li>the disease is listed in one of the table of occupational disease,<\/li>\n<li>the victim has been exposed to a risk,<\/li>\n<li>the disease has been certified by a doctor\u00a0within a set time limit ( specified in the table) : the starting point of this period is the end of the exposure to the risk.<\/li>\n<\/ul>\n<h3><a name=\"lien2\"><\/a>\u00a0The declaration of the occupational disease<\/h3>\n<p>According to the French Social security Code\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006743140&amp;cidTexte=LEGITEXT000006073189&amp;dateTexte=20140507&amp;oldAction=rechCodeArticle&amp;fastReqId=1207143824&amp;nbResultRech=1\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article L. 461-5<\/a><span style=\"text-decoration: underline;\">, i<\/span>t is<strong> the victim himself \u00a0who must declare the disease<\/strong> to the the Primary Sickness Insurance Fund (Caisse primaire d\u2019assurance maladie) by sending in a copy of the medical certificate delivered by the practitioner.<br \/>\nThe victim has to use a\u00a0<a href=\"http:\/\/www.ameli.fr\/fileadmin\/user_upload\/formulaires\/S6100.pdf\" target=\"_blank\" rel=\"noopener\">specific declaration form <\/a>which must be forwaded to the Social Security within 15 days\u00a0after cessation of work or\u00a0initial detection<\/p>\n<h3><a name=\"lien3\"><\/a>\u00a0Original medical certificate<\/h3>\n<p>The victims&#8217;s declaration\u00a0be accompanied by an original medical certificate : the practitioner makes out and gives to the victim a medical certificate.<\/p>\n<p>The practitioner has to use a\u00a0<a href=\"http:\/\/www.ameli.fr\/fileadmin\/user_upload\/formulaires\/S6909.pdf\" target=\"_blank\" rel=\"noopener\">specific certificate form Cerfa S 6909a ou 11139*01\u00a0<\/a><\/p>\n<ul>\n<li>This medical certificate notifies \u00a0:\n<ul>\n<li>the<strong> nature<\/strong> of the disease,<\/li>\n<li>the<strong> symptoms<\/strong> related to the hazard,<\/li>\n<li>its likely <strong>consequences<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>the medical certificate is in quadruplicate,<\/strong>\n<ul>\n<li>one copy of which contains no information concerning the disease and is to be given to the employer.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><a name=\"lien4\"><\/a>\u00a0Inquiry<\/h3>\n<p>The Social Security begins systematically a medical and administrative inquiry when a work-related illness is declared.<br \/>\nThe investigator meet the victim, the employer and sometimes he shall obtain the opinion of the occupational doctor.<\/p>\n<p>According to the French Social security Code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006073189&amp;idArticle=LEGIARTI000006750415&amp;dateTexte=20081005\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article R. 441-10 )<\/a>,<strong>\u00a0the Social security has 3 months to make its decision : <\/strong>disease is or is not occupational.<br \/>\nA period of further 3 months may be necessary to the Social security to make its decision : it shall inform the victim.<\/p>\n<h3><a name=\"lien5\"><\/a>\u00a0Final medical certificate<\/h3>\n<p>When the victim has been cured or his condition stabilized, the practitioner write a<strong> final medical certificate<\/strong> that states the consequences of the disease. This certificate \u00a0is in quadruplicate.<br \/>\nIn case of after-effects, caused by an\u00a0<a href=\"http:\/\/www.atousante.com\/en\/occupational-accidents\/\" target=\"_blank\" rel=\"noopener\">occupational accident<\/a>\u00a0or an\u00a0<a href=\"http:\/\/www.atousante.com\/en\/occupational-diseases\/\" target=\"_blank\" rel=\"noopener\">occupational disease,\u00a0<\/a>\u00a0the victim is entitled to receive a<strong> partial permanent disability<\/strong>.<\/p>\n<p>It is the physician of Social Security who sets the rate for the partial permanent disability.<\/p>\n<p class=\"bloc-important\">\u00a0Any doctor, in whatever position or function he may be practising his profession, is therefore concerned by the occupational disease declaration and compensation system : it is the doctor\u2019s responsibility to enquire after the patient\u2019s occupation and type of work, and what substances the patient handles.<\/p>\n<p><script async
