{"id":3383,"date":"2013-01-28T00:01:41","date_gmt":"2013-01-27T23:01:41","guid":{"rendered":"http:\/\/www.atousante.org\/?p=3383"},"modified":"2018-02-19T08:58:24","modified_gmt":"2018-02-19T06:58:24","slug":"visites-medicales-periodiques","status":"publish","type":"post","link":"https:\/\/www.atousante.com\/en\/visites-medicales-periodiques\/","title":{"rendered":"Periodical medical checks"},"content":{"rendered":"<blockquote><p>The periodical medical check is an opportunity to review the worker&#8217;s health, to inquire on the medical consequences of the occupational exposures at work\u00a0and\u00a0ensures that the employee is able to work.<!--more--><\/p><\/blockquote>\n<p><a href=\"#lien1\">Periodical medical checks : Labor code<\/a><br \/>\n<a href=\"#lien2\">Frequency of the medical examinations<\/a><br \/>\n<a href=\"#lien3\">Further details on medical check<\/a><\/p>\n<h3><a name=\"lien1\"><\/a>Periodical medical checks : Labor code<\/h3>\n<h2>When medical supervision is not strenghtened<\/h2>\n<p>If the medical supervision is not stenghtened , according to the labor code <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=2582421614E158E508B3E317EC096D56.tpdjo03v_2?idArticle=LEGIARTI000025279646&amp;cidTexte=LEGITEXT000006072050&amp;categorieLien=id&amp;dateTexte=20120630\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article R 4624-16\u00a0 <\/a>,\u00a0 the employees benefit from health check up every 24 months, or more,\u00a0 if the Occupational health service\u00a0 organize<strong> health talks with nurse<\/strong> between two medical checks with the occupational physician and multidisciplinary actions every year ( for some professional sectors or geographical areas, but not for individual companies<\/p>\n<h2>When medical supervision is strenghtened<\/h2>\n<p>When the employee is <a href=\"http:\/\/www.atousante.com\/en\/medical-examinations\/differente-medical-supervisions\/strengthened-medical-supervision-exposition-specific-occupational-hazards\/\" target=\"_blank\" rel=\"noopener\">exposed to certain occupational risks, physical, chemical or biological<\/a>, the medical supervision has to be strengthened, but also when the <a href=\"http:\/\/www.atousante.com\/en\/medical-examinations\/differente-medical-supervisions\/strengthened-medical-supervision-case-particular-personal-situations\/\" target=\"_blank\" rel=\"noopener\">worker has an individual situation<\/a> which is particular.<\/p>\n<p>According to the Franch Labour Code (article<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=0416EA76DDEFE488E8219EEBE76F786A.tpdjo03v_2?idArticle=LEGIARTI000025279634&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120701&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\"> R. 4624-19<\/a>), the periodical medical checks take place every 12 months or every 24 months : the health occupational physician can decide to change the frequency of the medical examinations\u00a0 in line with recommendations for good practice which are available in health at work.<\/p>\n<blockquote>\n<p class=\"bloc-important\">For employees who are exposed to ionising radiations, only A category\u00a0 employees\u00a0 have a strengthened medical supervision, while B category employees have a simple medical supervision. But for the A category employees, the medical examination is necessary annual.<\/p>\n<\/blockquote>\n<h3><a name=\"lien2\"><\/a>Frequency of the medical examinations<\/h3>\n<ul>\n<li>\u00a0Every 24 months if it is a<a href=\"http:\/\/www.atousante.com\/en\/medical-examinations\/differente-medical-surveillances\/simple-medical-surveillance\/\" target=\"_blank\" rel=\"noopener\"> simple medical surveillance<\/a><\/li>\n<li>Every year if it is a<a href=\"http:\/\/www.atousante.com\/en\/medical-examinations\/differente-medical-surveillances\/strengthened-medical-supervision-exposure-specific-occupational-hazards\/\" target=\"_blank\" rel=\"noopener\"> strengthened supervision in case of exposure to specific occupational hazards<\/a>\u00a0or in case o<a href=\"http:\/\/www.atousante.com\/en\/medical-examinations\/differente-medical-surveillances\/strengthened-medical-supervision-case-particular-personal-situations\/\" target=\"_blank\" rel=\"noopener\">f particular personal situations<\/a> ( pregnant women, disabled worker, etc)<\/li>\n<li>According to the French Labour Code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006902535&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120509&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article L 3122-42<\/a> and\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000018534508&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120701&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article R 3122-19)<\/a>, when an employee work during the night, the\u00a0periodical medical checks must take place every 6 months.<\/li>\n<\/ul>\n<p>The health occupational physician can decide to change the frequency of the medical examinations\u00a0 in line with recommendations for <a href=\"http:\/\/www.atousante.com\/en\/medical-examinations\/differente-medical-surveillances\/strengthened-medical-supervision-exposure-specific-occupational-hazards\/#lien6\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">good practices which are available in health at work.<\/a><\/p>\n<h3><a name=\"lien3\"><\/a>Further details on medical check<\/h3>\n<p>Some testings are done in the occupational health service : urinary examination, eye test, lung function tests, etc but sometimes he needs additional testings, according to the professional exposure.<\/p>\n<h2>Cost of additional testings prescribed by the health physician<\/h2>\n<p>The occupational doctor may request additional medical examinations such chest x-ray, blod test<\/p>\n<p>When the enterprise has its own occupational health service ( called in French &#8220;service autonome de sant\u00e9 au travail&#8221;), it is the employer who has to pay for these additional testings and when it is an inter-company occupational service, it is the occupational service which has to pay, according to the French Labour Code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=0416EA76DDEFE488E8219EEBE76F786A.tpdjo03v_2?idArticle=LEGIARTI000025279612&amp;cidTexte=LEGITEXT000006072050&amp;categorieLien=id&amp;dateTexte=20120701\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article R 4624-26 )<\/a>.<\/p>\n<p><span class=\"bloc-important\">Since july 2012, the additional testings have to be done on condition of anonymity.<\/span><\/p>\n<h2>Certificate issued during the periodical medical check-up<\/h2>\n<p>A report is filed by the occupational physician after each medical examination. The doctor has to give his opinion : the employee is fit or unfit to work, a workstation layout is necessary, etc<\/p>\n<p>One copy of this<a href=\"http:\/\/www.atousante.com\/en\/fit-unfit\/fit-unfit-work\/certificate-fitness-for-work\/\" target=\"_blank\" rel=\"noopener\"> certificate of fitness for work<\/a> \u00a0is given to the employer and the other is for the employee. Usually the occupational physician keep a copy too in the medical record of occupational health.<\/p>\n<p>According to the French Labour Code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=0416EA76DDEFE488E8219EEBE76F786A.tpdjo03v_2?idArticle=LEGIARTI000025274711&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120701&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article R 4624-35<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=0416EA76DDEFE488E8219EEBE76F786A.tpdjo03v_2?idArticle=LEGIARTI000025274715&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120701&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article R 4624-36<\/a>)<\/p>\n<p class=\"bloc-important\">The employer or the employee may contest the opinion delivered by the occupational physician : he has the right to an administrative appeal with the labour inspector. They have a maximum period of 2 months to dispute the doctor&#8217;s opinion.<\/p>\n<h3>Time spent on the medical examination<\/h3>\n<p>Time spent on the medical examination and on prescribed tests is
