It is also something that has happened at a specific time and a known place.<!--more--><\/p><\/blockquote>\n<p><a href=\"#lien1\">What formalities are required in case of an occupational accident in a temporary worker\u00a0<\/a><br \/>\n<a href=\"#lien3\">Cost of an occupational accident<\/a><br \/>\n<a href=\"#lien4\">Occupational accident: user company&#8217;s liability<\/a><br \/>\n<a href=\"#lien5\">Training safety of the temporary workers<\/a><br \/>\n<a href=\"#lien6\">Personal protective equipment, PPE<\/a><br \/>\n<strong><a href=\"#lien10\"><br \/>\n<\/a><\/strong><\/p>\n<h3><a name=\"lien1\"><\/a>What formalities are required\u00a0in case of an occupational accident in a temporary worker<\/h3>\n<p><strong>The agency for temporary personnel\u00a0is the employer and has to :<\/strong><\/p>\n<ul>\n<li><a href=\"http:\/\/www.atousante.com\/en\/occupational-accidents\/occupational-accidents-formalities\/administrative-formalities-employer-occupational-accident\/\" target=\"_blank\" rel=\"noopener\">send to the Social security within 48 hours<\/a> the work accident declaration<\/li>\n<li>and then to arrange a<a href=\"http:\/\/www.atousante.com\/en\/medical-examinations\/compulsory-optional-medical-examination\/reinstatement-visit\/\" target=\"_blank\" rel=\"noopener\"> reinstatement visit <\/a>with the occupational physician when worker has stopped to work at least for 30 days.<\/li>\n<\/ul>\n<p><strong>The temporary worker has to :<\/strong><\/p>\n<ul>\n<li>declare the accident to the<strong> user undertaking<\/strong> within 24 hours,<\/li>\n<li>to inform the <strong>temporary agency<\/strong> within 24 hours,<\/li>\n<li>to fill in a specific form called in French &#8220;<strong>information pr\u00e9alable \u00e0 la d\u00e9claration d&#8217;accident du travail&#8221;\u00a0<\/strong>:\u00a0<a href=\"http:\/\/www.ameli.fr\/fileadmin\/user_upload\/formulaires\/S6209.pdf\" target=\"_blank\" rel=\"noopener\"> formulaire S 609<br \/>\n<\/a>He must send it to the temporary agency, the labor inspector and\u00a0the Regional health insurance prevention service, called in French CARSAT, Caisse d\u2019Assurance Retraite et de Sant\u00e9 au Travail.<a href=\"http:\/\/www.ameli.fr\/fileadmin\/user_upload\/formulaires\/S6209.pdf\" target=\"_blank\" rel=\"noopener\"><br \/>\n<\/a><\/li>\n<\/ul>\n<p class=\"bloc-important\">In case of serious industrial accident, the worker should contact\u00a0<a href=\"http:\/\/www.fastt.org\/\" target=\"_blank\" rel=\"noopener\">\u00a0FASTT : Fonds d&#8217;Action Social du Travail Temporaire <\/a>\u00a0at the following number\u00a0: 0800 28 08 28.<\/p>\n<p><strong>The user undertaking has to inform within 24 hours :<\/strong><\/p>\n<ul>\n<li>the temporary agency,\u00a0<strong><br \/>\n<\/strong><\/li>\n<li>the \u00a0Regional health insurance prevention service, called in French CARSAT, Caisse d\u2019Assurance Retraite et de Sant\u00e9 au Travail,<\/li>\n<li>the labour inspectorate.<\/li>\n<\/ul>\n<h3><a name=\"lien3\"><\/a>Cost of an occupational accident<\/h3>\n<p class=\"bloc-important\">The cost is spread over the temporary agency and the user undertaking.<\/p>\n<p>Calculating the rate of occupational accident contribution\u00a0 :<\/p>\n<ul>\n<li><strong>a third<\/strong> for the user undertaking, .<\/li>\n<li><strong>two third<\/strong>s for the temporary agency<strong>.<\/strong><\/li>\n<\/ul>\n<h3><a name=\"lien4\"><\/a>Occupational accident: user company&#8217;s liability<\/h3>\n<p>The user company&#8217;s liability may be held liable in case of <strong>\u00a0inexcusable conduct<\/strong> ( called in French\u00a0<em>faute inexcusable<\/em>).<\/p>\n<h3><a name=\"lien5\"><\/a>Training safety of the temporary workers<\/h3>\n<p>According to the French labor code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=22796E94DC5094A03F3B07A97C64DB40.tpdjo17v_3?idArticle=LEGIARTI000006901298&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120729&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article L. 1251-42<\/a>), the contract between the user company and the temporary employment agency ( called in French\u00a0<em>contrat de mise \u00e0 disposition<strong>),\u00a0<\/strong><\/em>specifies the <strong>risks to the health and safety<\/strong> at the workstation.<br \/>\nThe user company has to list the workstations with exposure to<strong> risks for health and security<\/strong>. The <a href=\"http:\/\/www.atousante.com\/en\/health-work\/occupational-doctor\/\" target=\"_blank\" rel=\"noopener\">occupational physician<\/a> and the <a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/health-safety-working-conditions-committee\/\" target=\"_blank\" rel=\"noopener\">Health, safety and working conditions Committee<\/a> give their opinion on these issues. \u00a0In case\u00a0of any special health and safety risks,\u00a0a rigorous standard of safety is necessary for the temporary workers.<\/p>\n<h3><a name=\"lien6\"><\/a>Personal protective equipment, PPE<\/h3>\n<p><span class=\"bloc-important\">The user undertaking is required to provide the personal protective equipments to the temporary workers.<\/span><\/p>\n<p>However, some\u00a0customised equipments may be provided by the temporary agency ( helmets, safety shoes, etc) :\u00a0\u00a0in the case in point, it must be recorded in\u00a0the contract between the user company and the temporary employment agency.<\/p>\n<p>The user undertaking must ensure that temporary workers do wear the individual protection equipments.<br
