{"id":3188,"date":"2014-05-11T10:38:07","date_gmt":"2014-05-11T09:38:07","guid":{"rendered":"http:\/\/www.atousante.org\/?p=3188"},"modified":"2018-02-19T09:12:52","modified_gmt":"2018-02-19T07:12:52","slug":"prohibited-works-temporary-workers","status":"publish","type":"post","link":"https:\/\/www.atousante.com\/en\/prohibited-works-temporary-workers\/","title":{"rendered":"Prohibited works by temporary workers"},"content":{"rendered":"<blockquote><p>A temporary contract of employment cannot be concluded for hazardous works unless the responsible of the user undertaking requests an authorization to the labour Inspectorate.<br \/>\n<!--more--><\/p><\/blockquote>\n<p><a href=\"#lien1\">Prohibited works by temporary workers and employees on fixed-term contracts<\/a><br \/>\n<a href=\"#lien2\">Requested derogation by the employer<\/a><br \/>\n<strong><a href=\"#lien10\"><br \/>\n<\/a><\/strong><\/p>\n<h3><a name=\"lien1\"><\/a>Prohibited works by temporary workers and employees on fixed-term contracts<\/h3>\n<p>According to the French labor code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000021199962&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120729&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article D. 4154-1<\/a>) the works \u00a0which expose to the following\u00a0hazardous chemical agents are forbidden by\u00a0temporary workers and employees on fixed-term contracts :<\/p>\n<ul>\n<li>asbestos,<\/li>\n<li>aromatic amines,<\/li>\n<li>sodium arsenite ,<\/li>\n<li>hydrogen arsenide,<\/li>\n<li>manufacture\u00a0of\u00a0auramine\u00a0\u00a0and magenta,<\/li>\n<li>beryllium and its salts,<\/li>\n<li>beta-naphtylamine,<\/li>\n<li>Bromine liquid or\u00a0gaseous\u00a0forms ,<\/li>\n<li>cadmium\u00a0: metallurgical works and smelting,<\/li>\n<li>solubles and mineral\u00a0\u00a0compounds of\u00a0cadmium,<\/li>\n<li>gaseous chlorine\u00a0with the exclusion of compounds,<\/li>\n<li>methyl chloride,<\/li>\n<li>vinyl chloride during\u00a0the\u00a0polymerization,<\/li>\n<li>mercury\u00a0dichloride, oxycyanide mercuric and alkyl derivatives of mercury,<\/li>\n<li>manganese\u00a0dioxide,<\/li>\n<li>fluorine gas\u00a0\u00a0and hydrofluoric acid,<\/li>\n<li>Iodine\u00a0solid or gas ou vapeur,\u00a0with the exclusion of compounds,<\/li>\n<li>carbon oxychloride,<\/li>\n<li>paraquat,<\/li>\n<li>\u00a0phosphorus, phosphorus pentafluoride, hydrogen phosphide,<\/li>\n<li>flax dusts\u00a0: exposure through inhalation,<\/li>\n<li>dusts of hard metal,<\/li>\n<li>\u00a0ionising radiations\u00a0: in areas where the dose rate may exceed 2 millisieverts,<\/li>\n<li>carbon disulphide,<\/li>\n<li>tetrachloroethane,<\/li>\n<li>tetrachloromethane,<\/li>\n<li>disinfestation of woods<\/li>\n<\/ul>\n<p>According to the French labor code (<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=22796E94DC5094A03F3B07A97C64DB40.tpdjo17v_3?idArticle=LEGIARTI000018532596&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120729&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article D. 4154-2<\/a><span style=\"text-decoration: underline;\">), t<\/span>hese prohibitions do not apply\u00a0when<strong> works are done\u00a0inside of an apparatus hermetically sealed<\/strong> .<\/p>\n<h3><a name=\"lien2\"><\/a>Requested derogation by the employer<\/h3>\n<p>A <strong>derogation<\/strong> shoud be request to the labor inspector so that the temporary worker or the employee on fixed-term contract is <strong>allowed to do works prohibited<\/strong> by the French labor code. The <a href=\"http:\/\/www.atousante.com\/en\/health-work\/occupational-doctor\/\" target=\"_blank\" rel=\"noopener\">occupational physician <\/a>and the company\u2019s <a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/health-safety-working-conditions-committee\/\" target=\"_blank\" rel=\"noopener\">health, safety and working conditions committee<\/a> have
