{"id":3181,"date":"2014-05-10T10:20:23","date_gmt":"2014-05-10T09:20:23","guid":{"rendered":"http:\/\/www.atousante.org\/?p=3181"},"modified":"2018-02-19T09:13:59","modified_gmt":"2018-02-19T07:13:59","slug":"temporary-contract-emplyment","status":"publish","type":"post","link":"https:\/\/www.atousante.com\/en\/temporary-contract-emplyment\/","title":{"rendered":"Temporary contract of employment"},"content":{"rendered":"<blockquote><p>The temporary worker is hired and paid by an\u00a0agency for temporary personnel which\u00a0assigned him to work under the direction and supervision of the user undertaking.\u00a0\u00a0There are temporary workers for all occupations.<!--more--><\/p><\/blockquote>\n<p><a href=\"#lien1\">Assignment&#8217;s contract for the temporary worker<\/a><br \/>\n<a href=\"#lien2\">Contract between the user company and the temporary employment agency<\/a><br \/>\n<a href=\"#lien3\">Assignment of the temporary worker<\/a><br \/>\n<a href=\"#lien4\">Using a temporary worker\u00a0<\/a><br \/>\n<strong><a href=\"#lien10\"><br \/>\n<\/a><\/strong><\/p>\n<h3><a name=\"lien1\"><\/a>Assignment&#8217;s contract for the temporary worker<\/h3>\n<p>It is the contract of employment between the temporary worker and the temporary employment agency which specifies :<\/p>\n<ul>\n<li><strong>occupational qualification\u00a0<\/strong>of the temporary worker,<\/li>\n<li><strong>wage<\/strong>,<\/li>\n<li>potentially <strong>probation period<\/strong>,<\/li>\n<li>Address of<strong> the complementary fund<\/strong>\u00a0of the temporary employment agency<\/li>\n<\/ul>\n<p>The assignment&#8217;s contract is called in French &#8220;contrat de mission&#8221;<\/p>\n<h3><a name=\"lien2\"><\/a>Contract between the user company and the temporary employment agency<\/h3>\n<p>In French this contract is called &#8220;Contrat de mise \u00e0 disposition&#8221;.<\/p>\n<p><strong>According to the French labor code (<\/strong><a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=22796E94DC5094A03F3B07A97C64DB40.tpdjo17v_3?idArticle=LEGIARTI000020959326&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120729&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article L. 1251 <\/a><strong><span style=\"text-decoration: underline;\">)<\/span><\/strong> this contract specifies the\u00a0risks to the health and safety\u00a0at this workstation.<\/p>\n<p>The user company has to list workstations with exposure to risks for health and security. The <a href=\"http:\/\/www.atousante.com\/en\/health-work\/occupational-doctor\/\" target=\"_blank\" rel=\"noopener\">occupational physician<\/a> and the\u00a0<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/health-safety-working-conditions-committee\/\" target=\"_blank\" rel=\"noopener\">Health, safety and working conditions Committee <\/a>give their opinion on these issues.<\/p>\n<p>This contract between the user company and the temporary employement agency has to specify :<\/p>\n<ul>\n<li>the <strong>reason of the use<\/strong> of a temporary worker ,<\/li>\n<li>minimum <strong>period of assignment<\/strong>,<\/li>\n<li><strong>risks<\/strong> to the health and safety\u00a0at the \u00a0workstation, should the medical supervision be strengthened<\/li>\n<li>the <strong>occupational qualifications<\/strong> required\u00a0,<\/li>\n<li>the<strong> place<\/strong> of assignment,<\/li>\n<li><strong>work schedule<\/strong>,<\/li>\n<li>which <strong>personal protective equipment<\/strong>, PPE, are necessary ( they are must be provide by the\u00a0temporary employement agency),<\/li>\n<li>a worker of the user company with the same occupational qualifications and at the same workstation should be \u00a0entitled to receive which<strong>\u00a0wage.<\/strong><\/li>\n<\/ul>\n<h3><a name=\"lien3\"><\/a>Assignment of the temporary worker<\/h3>\n<p>A temporary worker is<strong> hired and paid<\/strong> by a\u00a0<strong>temporary employment agency<\/strong> which\u00a0assigned him to work under the direction and supervision of a user undertaking for a limited period.<\/p>\n<p><span class=\"bloc-important\">The duration of the assignment does not \u00a0exceed\u00a0 18 months, or \u00a024 mois for a foreign assignment.<br \/>\n<\/span><\/p>\n<p>A contract cannot be concluded \u00a0for\u00a0hazardous works.<\/p>\n<p>The employer is responsible for safety at work for his employees and the temporary workers too.<\/p>\n<h3><a name=\"lien4\"><\/a>Using a temporary worker<\/h3>\n<p>The user undertaking may use a temporary worker only in the following cases :<\/p>\n<ul>\n<li>temporary replacement\u00a0for an <strong>absent employee,<\/strong><\/li>\n<li>temporary replacement\u00a0for a<strong>\u00a0manager of a craft company,<\/strong><\/li>\n<li>temporary replacement\u00a0for a\u00a0<strong>head of an agricultural holding<\/strong>\u00a0,<\/li>\n<li><strong>expecting a new employee<\/strong> takes up his post,<\/li>\n<li><strong>temporary increase in activity<\/strong> in the user undertaking<strong>,\u00a0<\/strong><\/li>\n<li><strong>seasonal works , etc<\/strong><\/li>\n<\/ul>\n<p><script async
