French law on disabled persons"},"content":{"rendered":"<blockquote><p>Since 1987, any French enterprise employing more than 20 employees is required to employ\u00a0at least 6 % of disabled workers.\u00a0<!--more--><\/p><\/blockquote>\n<p>Any French body or firm, whether public or private,\u00a0\u00a0employing more than 20 employees is required to issue every year before 15 February a <strong>mandatory employment of disabled workers declaration<\/strong>.<\/p>\n<p><strong>For this declaration is considered to be disabled worker :<\/strong><\/p>\n<ul>\n<li>anyone who has obtained a\u00a0<a href=\"http:\/\/www.atousante.com\/en\/particular-situations\/disabled-worker\/recognition-status-disabled-worker\/\" target=\"_blank\" rel=\"noopener\">recognition of the status of disabled worker\u00a0from the public body called in French <em>Commission des Droits et de l\u2019Autonomie, CDAPH<\/em><\/a>,<\/li>\n<li>the victims of<a href=\"http:\/\/www.atousante.com\/en\/occupational-accidents\/occupational-accidents-definition\/\" target=\"_blank\" rel=\"noopener\"> work accident<\/a> or <a href=\"http:\/\/www.atousante.com\/en\/occupational-diseases\/list-tables-occupational-diseases\/list-french-tables-occupational-diseases\/\" target=\"_blank\" rel=\"noopener\">occupational disease <\/a>who receive a<a href=\"http:\/\/www.atousante.com\/en\/occupational-accidents\/recognition-compensation-occupational-accidents\/partial-permanent-disability-pension\/\" target=\"_blank\" rel=\"noopener\"> partial permanent disability<\/a> ( only if the rate at least equal 10 %),<\/li>\n<li>anyone who receives \u00a0an invalidity pension (called in French <em>pension d&#8217;invalidit\u00e9)<\/em><\/li>\n<li>holders of a disability card ,<\/li>\n<li>anyone who receives a disabled adults&#8217; allowance<strong>\u00a0<\/strong>(called in French <em><strong>A<\/strong>llocation aux<strong> A<\/strong>dultes <strong>H<\/strong>andicap\u00e9s, AAH<\/em>)<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span class=\"bloc-important\">One disabled worker shall be counted as a single unit , no matter what the form of his disability : there is no more category A,B and C ( they have been dropped).<\/span><\/p>\n<p>A lot of <strong>subsidies<\/strong> are available to facilitate <strong>recruitment<\/strong> and keeping disabled persons in work.<\/p>\n<p>If the <strong>undertaking employs not enough disabled workers<\/strong>, it has to pay a contribution to the\u00a0public body called in French\u00a0<em><a href=\"http:\/\/www.agefiph.fr\/\" target=\"_blank\" rel=\"noopener\">Agefiph, Association nationale de gestion du fonds pour l\u2019insertion professionnelle des travailleurs handicap\u00e9s.<\/a><\/em><\/p>\n<p>A disabled worker is <strong>not\u00a0protected against dismissal<\/strong>, however the notice period is doubled ( it is paid) , only in case of occupational disease or occupational accident.<br \/>\n<script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js\"><\/script><br \/>\n<ins
