{"id":2878,"date":"2014-05-07T23:14:10","date_gmt":"2014-05-07T22:14:10","guid":{"rendered":"http:\/\/www.atousante.org\/?p=2878"},"modified":"2018-02-19T09:39:28","modified_gmt":"2018-02-19T07:39:28","slug":"partial-permanent-disability-pension","status":"publish","type":"post","link":"https:\/\/www.atousante.com\/en\/partial-permanent-disability-pension\/","title":{"rendered":"The partial permanent disability pension"},"content":{"rendered":"<blockquote><p>When the occupational accident or the occupational disease causes after-effects, the victim is entitled to receive a compensation \u00a0: partial permanent disability pension. \u00a0For any work-related or occupational disease,\u00a0the practitioner issues a medical certificate that states the victim has been cured or his condition stabilized and what the final consequences are. \u00a0<!--more--><\/p><\/blockquote>\n<p>It is only the <strong>medical officer ( Social security)<\/strong> who can fix a <strong>partial permanent disability rate,<\/strong> i.e. impairment to physical and psychological integrity.<\/p>\n<p>According to the French Social security code ( <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000017842784&amp;cidTexte=LEGITEXT000006073189&amp;dateTexte=20100314&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article L. 434-2<\/a><span style=\"text-decoration: underline;\">)<\/span>, this medical officer ( Social security) <strong>estimates the rate\u00a0<\/strong>of the partial permanent disability, \u00a0according to his victim&#8217;s medical examination and the final consequences written by the practitioner on the final certificate .<\/p>\n<p><strong>He uses scales to determine this rate :<\/strong><\/p>\n<ul>\n<li>a scale is specific for the work accidents,\n<ul>\n<li>called in French : <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do;jsessionid=7207DA862F314C61A097245EE17E8E30.tpdjo13v_3?idSectionTA=LEGISCTA000006126942&amp;cidTexte=LEGITEXT000006073189&amp;dateTexte=20101025\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Bar\u00e8me d&#8217;invalidit\u00e9 suite \u00e0 un accident du travail<\/a>,<\/li>\n<\/ul>\n<\/li>\n<li>another sacale is specific for the occupational diseases,\n<ul>\n<li>called in French <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do;jsessionid=7207DA862F314C61A097245EE17E8E30.tpdjo13v_3?idSectionTA=LEGISCTA000019325196&amp;cidTexte=LEGITEXT000006073189&amp;dateTexte=20101025\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Bar\u00e8me d&#8217;invalidit\u00e9 suite \u00e0 une maladie professionnelle<\/a>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"bloc-important\">These scales are indicative.<\/p>\n<p>The <strong>partial permanent disability pension<\/strong> compensates\u00a0for physical and mental harm, loss of earnings, however the pain is not compensated. The pain is compensated too only \u00a0in the case of recognition of inexcusable negligence by the employer. Sometimes it is proved the occupational accident or the occupational disease was caused by an inexcusable negligence ( called in French &#8220;<a href=\"http:\/\/www.atousante.com\/obligations-employeur\/sante-securite\/responsabilite-de-employeur\/#lien2\" target=\"_blank\" rel=\"noopener\">Faute inexcusable<\/a>&#8220;.)<\/p>\n<p><strong>Compensations for permanent disability may be paid :<\/strong><\/p>\n<ul>\n<li>as a<strong> capital<\/strong> (lump sum), when the permanent disability rate is<strong> less than 10 %<\/strong>,<\/li>\n<li>or as a <strong>pension<\/strong> when this rate is <strong>equal or superior to 10 %<\/strong> : the pension is <strong>paid every three months<\/strong>.<br \/>\nAny victim can convert a quarter of his pension in capital.<\/li>\n<\/ul>\n<p>It is a<strong> life annuity<\/strong> which means that the pension is paid up to the death of the victim.<\/p>\n<p>In case of <strong>fatal occupational accident<\/strong>s, the pension is paid to the right holders.<\/p>\n<p>If \u00a0the permanent disability rate is<strong>\u00a0less than 10 %<\/strong>,\u00a0the victim is entitled to receive the following capital ( it is not linked to the wage), according to the French Social security code ( <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006736995&amp;cidTexte=LEGITEXT000006073189&amp;dateTexte=20140511&amp;oldAction=rechCodeArticle&amp;fastReqId=1822135931&amp;nbResultRech=1\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">article D 434-1<\/a>) :<\/p>\n<ul>\n<li><strong>1% d&#8217;IPP : <\/strong>capital paid is\u00a0342,94 \u20ac<\/li>\n<li><strong>2% d&#8217;IPP:\u00a0<\/strong>\u00a0capital paid is\u00a0557,34 \u20ac<\/li>\n<li><strong>3% d&#8217;IPP<\/strong>:\u00a0<strong>\u00a0<\/strong>capital paid is\u00a0814,41 \u20ac<\/li>\n<li><strong>4% d&#8217;IPP:\u00a0<\/strong>\u00a0capital paid is\u00a01 285,37 \u20ac<\/li>\n<li><strong>5% d&#8217;IPP<\/strong>:\u00a0<strong>\u00a0<\/strong>capital paid is\u00a01 628,31 \u20ac<\/li>\n<li><strong>6% d&#8217;IPP:<\/strong>\u00a0<strong>\u00a0<\/strong>capital paid is\u00a02 013,92 \u20ac<\/li>\n<li><strong>7% d&#8217;IPP<\/strong>:\u00a0<strong>\u00a0<\/strong>capital paid is\u00a02 442,21 \u20ac<\/li>\n<li><strong>8% d&#8217;IPP:<\/strong>\u00a0<strong>\u00a0<\/strong>capital paid is\u00a02 913,69 \u20ac<\/li>\n<li><strong>9% d&#8217;IPP<\/strong>:\u00a0<strong>\u00a0<\/strong>capital paid is\u00a03 427,84 \u20ac<\/li>\n<\/ul>\n<p>In French, partial permanent disability is called\u00a0<a href=\"http:\/\/www.atousante.com\/accidents-travail\/reconnaissance-indemnisation-at\/rente-incapacite-permanente-partielle\/\" target=\"_blank\" rel=\"noopener\">Incapacit\u00e9 Permanente Partielle, IPP<\/a>)<\/p>\n<p class=\"bloc-important\">\u00a0Any victim may contest the rate.<\/p>\n<p><strong>In the event of a relapse or an aggravation in the victim&#8217;s state of health<\/strong> following the occupational accident or the occupational disease, the rate may be reviewed by the social security .<br \/>\n<script async
