including fumes and dusts,\u00a0is considered as an<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/painfulness-work\/hardship-work-occupational-risks\/\" target=\"_blank\" rel=\"noopener\"> hardship factor<\/a>,\u00a0according to the French Labour Code\u00a0\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000025739703&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120814&amp;fastPos=1&amp;fastReqId=1031440802&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">R. 4412-3<\/a>\u00a0et\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000025739694&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120814&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">R. 4412-60<\/a>\u00a0: it is en\u00a0<\/span><strong>aggressive physical environment.<\/strong><\/p>\n<p>The employer must write on this \u00a0document,\u00a0<a href=\"http:\/\/www.atousante.com\/en\/employer-obligations\/painfulness-work\/prevention-hardship-work-employer-duty\/\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Prevention of exposures sheet\u00a0(called in French &#8220;Fiche de pr\u00e9vention des expositions&#8221;)<\/a>\u00a0when the exposure has started and which\u00a0preventive measures have been \u00a0taken.<\/p>\n<p class=\"bloc-important\">&#8221; Prevention&#8221; is not a very good term because in fact this \u00a0document, called in French &#8220;Fiche de pr\u00e9vention des expositions&#8221; keeps track of professional exposures\u00a0to\u00a0harshness factors\u00a0but do not really prevent the professional exposures.<\/p>\n<p><a href=\"http:\/\/www.legifrance.gouv.fr\/jopdf\/common\/jo_pdf.jsp?numJO=0&amp;dateJO=20120131&amp;numTexte=41&amp;pageDebut=01796&amp;pageFin=01797%20\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">A sample sheet is given by the French labor code<\/a>.<br \/>\nAtouSante proposes a Word template in French for this document \u00a0\u00a0<a href=\"http:\/\/www.atousante.com\/en\/wp-content\/uploads\/2012\/02\/Fiche-de-pr\u00e9vention-des-expositions-\u00e0-certains-facteurs-de-risques-professionnels.doc\">Fiche de pr\u00e9vention des expositions \u00e0 certains facteurs de risques professionnels<\/a><\/p>\n<p>This document must be regularly updated.<\/p>\n<p>There is another specific document for\u00a0exposure to asbestos at work according to the French labor code\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000025253619&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20121014&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">Article D. 4121-9\u00a0<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000025253580&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120201&amp;oldAction=rechCodeArticle\" target=\"_blank\" rel=\"noopener\" class=\"broken_link\">R. 4412-110<\/a>.<br \/>\nAdditional informations must be written, in case of exposure to asbestos, such as :<\/p>\n<ul>\n<li>the characteristics of the used \u00a0materials,<\/li>\n<li>the nature of the work carried out,<\/li>\n<li>periods of exposure,<\/li>\n<li>other occupational risks ( chemical, physical or biological),<\/li>\n<li>the dates and results of exposure controls at the workstation,<\/li>\n<li>accidental exposures,<\/li>\n<li>procedures and work methods employed ,<\/li>\n<li>collective and individual protective equipment, etc<\/li>\n<\/ul>\n<p><strong>\u00a0Penalties for the French employer who has not done or updated these documents ( prevention of exposure sheet)\u00a0<\/strong><\/p>\n<p>He will have to pay :<\/p>\n<ul>\n<li>1500 euros for a natural person (it would be necessary to multiply by the number of workers concerned).<\/li>\n<li>7 500 euros for a body corporate.<\/li>\n<\/ul>\n<p><script async
