Who is entitled to a disability pension ?
According to the French Social security code article L341-1, when a worker has lost two-thirds of his workforce, because of an illness, he is entitled to a disability pension.

An insured person which has lost two-thirds of his workforce is entitled to a disability pension only in case of an ordinary disease.
It is not possible in case of an occupational disease or an occupational accident.
In case of an occupational disease or occupational accident, the worker is entitled to receive a compensation as partial permanent disability pension
Medical officer of Social security awards or not a disability pension
After a long period of sick leave ( in France a sick leave shall not exceed a total of three years), the medical officer may award a disability pension.
However, a patient or his attending physician may request a disability pension to the medical officer of Social security.
Disability pension : three categories
Relating to the health status of the person, the medical officer of Social security decides which category is necessary.
- First category disability pension
- the worker is able to work part-time,
- he is entitled to receive a disability pension : 30 percent of the average annual salary ( based on the best ten years’ salary).
- Minimum monthly amount 279,98 €
- Maximum monthly amount 938,70 €
- Second category disability pension
- the person is no longer able to work,
- he is entitled to receive a disability pension : 50 percent of the average annual salary ( based on the best ten years’ salary).
- Minimum monthly amount 279,98 €
- Maximum monthly amount 1564,50 €
- Third category disability pension
- the person needs the assistance of a third party in order to perform everyday acts.
- he is entitled to receive a disability pension : 50 percent of the average annual salary ( based on the best ten years’ salary)
- Minimum monthly amount 279,98 € + 1 103,08 allowance for third party,
- Maximum monthly amount 1564,50 € + 1 103,08 allowance for third party.
